Diese Allgemeinen Geschäftsbedingungen kommen bei jedem Angebot der Mundart Schule zur Anwendung. Gültigkeit: ab Februar 2022.

Zahlung des Kursgeldes

Die schriftliche Anmeldung verpflichtet Sie zur Zahlung des Kursgeldes. Das Nichtbezahlen des Kursgeldes gilt nicht als Abmeldung.

Kursorganisation

Aus organisatorischen Gründen behalten wir uns vor, Klassen zeitlich zu verschieben oder zusammenzulegen oder Kurse bei prozentualer Rückerstattung des Kursgeldes zu kürzen. Fällt eine Kursleitung aus, kann die Schulleitung einen Kursleiterwechsel vornehmen oder eine Stellvertretung einsetzen.

Kursplätze und Durchführung

Um unsere Kurse unter optimalen Bedingungen durchführen zu können, legen wir für jeden Kurs eine minimale (3 Teilnehmer) und eine maximale (5 Teilnehmer) Teilnehmerzahl fest. Die Kursplätze werden in der Reihenfolge der Anmeldungen vergeben (unter Vorbehalt der rechtzeitigen Zahlung). Bei ungenügender Teilnehmerzahl wird der Kurs in der Regel nicht durchgeführt und das Kursgeld erlassen bzw. rückerstattet.

Dies gilt nicht bei Privatkursen (1 Teilnehmer) oder Halbprivatkursen (2 Teilnehmer).

Kursausschluss

Die Schulleitung behält sich vor, einen oder mehrere Kursteilnehmende aus einem Kurs begründet auszuschliessen. In folgenden Fällen ist das ganze Kursgeld geschuldet, d.h. es erfolgt weder eine anteilsmässige Rückerstattung noch ein Erlass des Kursgeldes: Kursausschluss aufgrund Nichtbezahlung des Kursgeldes sowie in schwerwiegenden Fällen (Ehrverletzung, Belästigung, etc.).

Kursbestätigung

Auf Ihren Wunsch und nach erfolgtem Besuch von mindestens 80 Prozent der Kurslektionen, stellen wir Ihnen gerne eine Kursbestätigung aus. Bedingung in beiden Fällen ist allerdings, dass Ihr Kurs nicht länger als ein Jahr zurückliegt.

Versicherung

Für alle von der Mundart Schule organisierten Kurse und Veranstaltungen schliessen wir jegliche Haftung für entstandene Schäden aus. Sie sind daher selber für eine ausreichende Versicherungsdeckung verantwortlich.

Abmeldungen

Jede Anmeldung ist verbindlich. Je nach Abmeldezeitpunkt können wir Ihnen das Kursgeld ganz oder teilweise erlassen. Bitte beachten Sie folgende Regelung:

Für eine gültige Abmeldung wird eine schriftliche Kursabmeldung benötigt. Als Eingangsdatum gilt der Poststempel Ihres Schreibens oder das Datum des Erhalts der Email. Der Erlass bzw. die Rückerstattung Ihres Kursgeldes ist wie folgt geregelt:

Nicht besuchte Lektionen können nicht nachgeholt werden und werden nicht rückerstattet.

Datenschutz

Die Mundart Schule bearbeitet die Daten, die Sie uns bei der Anmeldung, bei der Durchführung des Kurses oder bei anderen Gegebenheiten (z.B. Events) geben, oder die wir in diesem Zusammenhang über Sie erhalten oder früher von Ihnen erhalten haben, mit grösster Sorgfalt und entsprechend den Regeln des schweizerischen Datenschutzes.

Eine Weitergabe der Daten ausserhalb der Mundart Schule erfolgt ausschliesslich unter strengen, vertraglichen Datenschutzauflagen an externe Dienstleister in der Schweiz oder im Ausland, aufgrund gesetzlicher Vorschriften an die Strafverfolgungsbehörden oder wenn eine Weitergabe zur Wahrung und Durchsetzung berechtigter Interessen der Migros notwendig ist.

Video- und Audio-Aufnahmen

Ohne ausdrückliches, schriftliches Einverständnis der Mundart Schule und der Kursteilnehmenden dürfen während der Online Lektionen keine Video- oder Audio-Aufnahmen gemacht werden.

Programm- und Preisänderungen

Programm- und Preisänderungen sowie Änderungen in den Allgemeinen Geschäftsbedingungen bleiben vorbehalten.

Gerichtsstand

Für alle Rechtsbeziehungen mit der Mundart Schule ist Schweizer Recht anwendbar. Gerichtsstand ist Zürich.

These General Terms & conditions (hereinafter referred to as «GTC’s) apply to all enrollments made and all contracts concluded through the website mundartschule.com or the office of Mundart Schule. (Validity: starting from February 22)
With your registration you accept the GTCs of Mundart Schule.

Payment of course fee

The booking of and registration to a course is binding and obliges the participant to pay the course fee. Prices are provided in Swiss francs and include any value-added tax (VAT). Failure to pay the course fee does not constitute a cancellation. Once they have enrolled for a course, participants will receive confirmation of their enrollment from Mundart Schule with binding payment instructions. Payment is due within 10 days after receiving of confirmation and payment instructions and before start of the course. For instalment payment option: First instalment is due before the course start, last instalment shall be paid before course end.

Course organisation

For organisational reasons, Mundart Schule reserves the right to postpone or combine courses or reduce the length of courses with a percentage refund of the course fees. If a course instructor drops out, Mundart Schule may change the course instructor or appoint a substitute.

Places on courses and delivery of courses

In order to deliver the courses under optimum conditions, Mundart Schule defines a minimum (3 participants) and maximum (5 participants) number of participants for each course that may be adjusted as necessary. Places on courses are allocated in the order that registrations are received (subject to payment made in due time).

If the number of participants is insufficient, the course will usually not be held, and the course fees will be waived or refunded. Mundart Schule further reserves the right to cancel courses announced in the programme for other reasons for which Mundart Schule is not responsible. Course fees that have already been paid will be refunded.

Exclusion from courses

Mundart Schule reserves the right to exclude participants from a course. The full course fee is owed in the following cases (i.e. neither a pro rata refund nor a waiver of the course fee will be given): exclusion from the course due to failure to pay the course fee or instalment and in serious cases (defamation, harassment, wilful damage to property, etc.).

Course confirmation

At a participant’s request and following successful completion of at least 80% of the course lessons, Mundart Schule will be happy to issue a course confirmation.

Disclaimer and insurance

Mundart Schule excludes all liability for any damage incurred for all courses and events organised by Mundart Schule. Participants are responsible for adequate insurance cover.

Enrollment and cancellation : payment of course fee

Each enrollment is binding and obliges the participant to pay the course fee. The duration of the contract depends on the course booked and is limited to a fixed term. Depending on the time of cancellation, Mundart Schule may waive the course fee in whole or in part subject to the following terms:

Mundart Schule requires participants to cancel their place on the course by post or by email to info@mundartschule.com (the date of receipt is deemed to be the postmark or sent date of email) . The course fees will be waived or refunded as follows:

Unattended lessons/appointments

Unattended lessons/appointments cannot be made up for and no refunds will be issued.

Data privacy statement

All personal data of our students is treated confidentially and according to Swiss rules of data protection. No personal data of our students will be given outside of Mundart Schule.

Video and audio recordings

Video or audio recordings may be made during online lessons only with the express consent of Mundart Schule and participants.

Modifications to the programme, prices and GTCs

Mundart Schule reserves the right to modify the programmes, the prices and the GTCs at any time. The version in force at the time of registration will apply in each case and may not be unilaterally amended for the purpose of concluding this contract.

Severability clause

Should any provision set out in these GTCs be invalid or incomplete or should performance become impossible, this will not affect the validity of the remaining parts. In such a situation, the invalid provision will be replaced by a permissibly valid provision by which the intended purpose of the contract can be achieved in a legally permissible manner and which, according to its content, reflects the original intention as closely as possible. The same applies if the contract contains a loophole.

Applicable law and place of jurisdiction

All legal relationships with Mundart Schule are governed by Swiss substantive law, to the full exclusion of any conflict of laws and the United Nations Convention on Contracts for the International Sale of Goods dated 11 April 1980.

The exclusive place of jurisdiction for all disputes arising from or in connection with these GTCs and the courses is Zurich, Switzerland.
